Illegal Foreclosures in Maryland

In early December, Progressive Maryland put out a press release regarding illegal foreclosures in the state. From the release:

It mystifies me that circuit court judges, notably in Montgomery and Prince George’s County courts, have for so long turned a blind eye to everyday people being robbed of their homes.

Our Task Force’s experts, including a number of attorneys and legal professionals, has highlighted the growing concern that in Maryland, justice is bought in circuit courts, not served.

Anatomy of the Scam

A Foreclosure Mill law firm initiates foreclosure proceedings against a homeowner. The homeowner, believing that the court cares about facts, shows the court they are not behind on their mortgage. The Foreclosure Mill uses their connections (nepotism, political contributions) to the Judge to ignore the facts.

The Judge forecloses on the property. The Foreclosure Mill receives a monetary award from the lender. The property goes to tax sale only advertised in the newspaper.

The Foreclosure Mill sends an attorney, or family member of an attorney, to purchase the property for a fraction of the actual cost at auction. Nobody else is present, as few people receive a local newspaper.

The property is re-sold at market value, reaping massive profits for the Foreclosure Mill and their agents.

Even with Executive Orders from Federal, State, and Local Executives, the Judges are ignoring these orders and foreclosing on homes.
